Membership Agreement
AgingWise is a California not-for-profit corporation that is tax-exempt under 501(c)(3) of the federal income tax law and is a member-based network of neighbors in Santa Clara County and its nearby cities. Its goal is to help its members to stay at home in their community as they age. AgingWise does this by building a trusted tight-knit community that links its members and their families with information and available services to enhance their aging-in-place life.
One of the AgingWise’s primary functions is to ensure the highest possible member satisfaction with the activities and services available on its platform. As all the contents are provided by members based on their best knowledge, AgingWise, however, will not under any circumstance assume any direct or indirect responsibility or liability in connection with any services, recommendations, and comments provided by any members on its platform.
As a member, I agree to pay the membership fee established by AgingWise. I agree to cooperate and contribute to the success of the AgingWise community. And I shall be in good standing in accordance with the AgingWise bylaw and relevant government regulations.
FEES: AgingWise membership fee is $60.00 per household per year and due annually starting at the beginning of each calendar year. New membership starts immediately after being granted and the first payment is either full annual fee if granted prior to June 30th or one half of the annual fee if granted after July 1st of that year and becomes due immediately. Membership fees might be changed at the beginning of each calendar year with advanced notices.
PRIVACY POLICY: AgingWise will not give, sell, or trade a member’s information as part of this agreement. For the latest detail, please read AgingWise Privacy Policy posted on AgingWise’s website.
TERMINATION OF AGREEMENT: AgingWise reserves the right in its sole discretion to terminate the agreement, at any time, if AgingWise determines that it is in the best interest of the AgingWise community, its volunteers, another member, or the undersigned Member(s). If AgingWise terminates this agreement, it will return a portion of the monthly fee paid on a prorated base from the date of termination. The undersigned member(s) may terminate this agreement at any time by providing written notice to AgingWise. If the member(s) terminate(s) this agreement, the part of the annual fee prorated to the remaining months shall be refunded.
WAIVER OF LIABILITY: AS AN AGINGWISE MEMBER I UNDERSTAND THAT AGINGWISE IS NOT AFFILIATED WITH THE THIRD-PARTY VENDORS IT OR ITS MEMBERS MAY RECOMMEND. THUS (i) I HEREBY RELEASE AND DISCHARGE AGINGWISE, ITS MEMBERS, VOLUNTEERS, EMPLOYEES, OFFICERS, AND DIRECTORS FROM ALL RESPONSIBILITY OR LIABILITY STEMMING FROM THE SERVICES CONDUCT BY AGINGWISE OR THIRD-PARTY PROVIDERS, AND (ii) I HOLD AGINGWISE HARMLESS FROM ANY LOSS, EXPENSE, LIABILITY OR DAMAGES (INCLUDE WITHOUT LIMITATION, REASONABLE ATTORNEY’S FEES) ARISING OUT OF THE ACTIVITIES of ITS EMPLOYEES OR VOLUNTEERS OR OTHER, INCLUDING BUT NOT LIMITED TO ANY ACTION I, MY HEIRS AND ASSIGNS, OR MY INSURANCE COMPANY MIGHT BRING FOR NEGLIGENCE, PERSONAL INJURY OR INVASION OF PRIVACY.
AS A MEMBER OF AGINGWISE, I UNDERSTAND THAT AGINGWISE IS NOT A PROVIDER OF EMERGENCY SERVICES OR HEALTHCARE SERVICES, IS NOT A HEALTHCARE ADMINISTRATOR, AND DOES NOT EMPLOY LICENSED HEALTH PROFESSIONALS OR SOCIAL WORKERS. THIS AGREEMENT IS NOT MEANT TO CREATE ANY SPECIAL RELATIONSHIP GIVING RISE TO A DUTY TO AID OR PROTECT BETWEEN MYSELF AND AGINGWISE.
I have read the above carefully, and I am pleased to become a member of AgingWise under the terms and conditions set in this agreement by AgingWise.
